When a loved one passes away, it can be a difficult time for you and your family. Administering an estate on top of grieving can be a tricky and stressful situation to find yourself in. If an individual had a Will, their estate would be distributed in accordance with the terms of their Will. If an individual did not have a Will, then their estate would be distributed in accordance with the Rules of Intestacy.

One off Advice
In certain circumstances, it may not be necessary to obtain a Grant of Representation; for example, if a jointly owned property passes automatically to the survivor or if there are minimal assets in the estate. We offer a fixed fee initial consultation to discuss the immediate next steps and to provide one off advice. The administration of the deceased estate is then passed to the Executor(s) or administrator.
Obtaining the Grant of Representation
If the deceased had a valid Will, then the executors may have to obtain a Grant of Probate. If the deceased did not have a valid Will, then the person entitled to administer the estate, may be required to obtain a Grant of Representation, also known as Letter of Administration. Our expert lawyers offer a package whereby we deal with the application for and obtaining the relevant Grant, then the estate is passed over to the named executors or administrator for them to deal with the closing of accounts and distribution of the estate.
Full Administration
For peace of mind, you may wish for our expert lawyers to deal with the full administration of the deceased estate. This package would include initially meeting with you to obtain the relevant details, notifying third parties and organisations, dealing with the application to obtain the relevant Grant of Representation and then arranging for the assets to be distributed in accordance with either the Will or the Intestacy Rules.
