If an individual had a Will, their estate would be distributed in accordance with the terms of their Will. If an individual did not have a Will, then their estate would be distributed in accordance with the Rules of Intestacy.

In certain circumstances, it may not be necessary to obtain a Grant of Representation; for example, if a jointly owned property passes automatically to the survivor or if there are minimal assets in the estate. The administration of the deceased estate is then passed to the Executor(s) or administrator.
If the deceased had a valid Will, then the executors may have to obtain a Grant of Probate. If the deceased did not have a valid Will, then the person entitled to administer the estate, may be required to obtain a Grant of Representation, also known as Letter of Administration.
