Alternative Dispute Resolution (ADR) is the generic term used to describe any process to resolve a dispute between two or more parties outside of the court room. It can be used instead of issuing a claim or at any stage in a claim. Indeed, the Civil Procedure Rules require the parties to keep ADR under review and a party who unreasonably refuses to engage in ADR can be penalised in costs. It applies across the spectrum of claims and whether you are an individual or business and whether you are bringing or defending a claim. The main methods of ADR are mediation or arbitration. Mediation in particular enables the resolution of a dispute on terms a court would not necessarily order.
